Monopolization: Monopolization occurs when a producer (1) secures the possession of monopoly power — that is, the power to fix prices and exclude competitors — within a particular market, and (2) acquires or maintains such power as distinguished from growth or development resulting from a superior product, business acumen or historical accident.
In brief, a monopoly is the practical suppression of effective business competition, which creates the power to control prices to the detriment of consumers. It occurs when one supplier or producer controls ― or obtains an advantage over ― a commercial market within a given region.
Certain monopolies, however, do not violate antitrust law, including:
- Bilateral monopoly. Occurs in a market in which there is only one buyer and one seller.
- Legal monopoly. The exclusive right granted by a government to a business to provide goods or services that are regulated by the government (e.g., electric utility companies).
- Natural monopoly. A monopoly resulting from a circumstance over which the monopolist has no power as when the market is so limited for a product that only one facility is needed to meet demand.
